Our client receives £60,000 compensation for an accident at work injury

The accident

Our client was employed at a factory specialising in the production of plastic containers and moulded plastic covers. While working on a production machine, he encountered a defect and followed the correct internal procedure to clear the blockage.

During this process, the machinery malfunctioned. As a result, his finger was caught in the equipment, causing a severe crushing and cutting injury, leading to the loss of the top half of his finger.

The employer disputed liability, arguing the incident was not caused by negligence. The claim was therefore contested from the outset, with the defendant’s insurers handling the matter on their behalf.

The injuries

The injury resulted in the partial amputation of the client’s finger, with significant ongoing physical and psychological impact.

He required treatment from specialist hand surgeons and underwent ongoing medical care to manage pain, function, and recovery. In addition to the physical trauma, he experienced psychological symptoms, including distress and anxiety related to both the accident and its long-term effect on his ability to work.

The injury also affected his capacity to carry out day-to-day work duties, resulting in a broader impact on his employment and earning ability.

The claim

A claim was brought against the employer on the basis that the machinery was defective and that appropriate safety standards were not being maintained. The central issue in dispute was liability, with the employer denying responsibility for the incident.

Medical evidence was gathered and updated throughout the course of the case, including reports from treating hand specialists and psychological experts. These reports helped demonstrate both the severity of the injury and its long-term consequences.

The claim was supported by detailed evidence showing the client had followed correct procedure at the time of the accident and that the injury occurred due to a fault in the machine rather than any error on his part.

The outcome

Following ongoing negotiations with the defendant’s insurers, the case was successfully resolved without the need for a court hearing.

An out-of-court settlement of £60,000 was secured for the client, reflecting both the physical injury sustained and the wider impact on his working life and wellbeing.
