Car park pot hole accident successfully settled out of court for our client

The accident

Our client, a 55-year-old woman, was injured after tripping over a large pothole in a hospital car park. She had been visiting a patient in the hospital and, after returning to her car, fell due to poor lighting and the presence of a significant, unmarked pothole.

Although the accident occurred two years before she approached us, we agreed to take on her case.

She had already reported the incident to the hospital, and we supported her claim with expert medical evidence from an orthopaedic surgeon.

The injuries

The accident resulted in multiple injuries, including:

  • A fracture to the right wrist
  • Soft tissue injury to the right shoulder

Unfortunately, our client was left with a permanent injury and an 8cm scar to her right wrist.

The claim

Initially, the hospital disputed that the accident had occurred as described. We carried out thorough investigations and gathered compelling evidence demonstrating the existence and dangerous condition of the pothole.

It is well known that hospital premises, including their car parks, can sometimes fall into poor states of repair. In this case, we were able to show that the hazard posed a clear risk to visitors.

The outcome

Based on the evidence obtained, we successfully argued that the Defendant had breached its duty of care.

Court proceedings were issued and served. Liability was eventually admitted, and the matter was settled out of court.

Our client was awarded £23,000 in damages.
